HAR §15-15-61. Disqualification

No commissioner or hearings officer shall sit in any proceeding in which the commissioner or hearings officer has a personal pecuniary or business interest, or one in which the commissioner or hearings officer is related within the first degree by blood or marriage to any party to the proceeding. Except that, if, after - 32 - Hawai`i Administrative Rules Title 15, Chapter 15 - Unofficial declaring the nature of the circumstances of the pecuniary interest or consanguinity to the parties, the parties do not oppose the commissioner or hearings officer sitting in a proceeding, the record shall note clearly the waiver by the parties.
