Within thirty days after the petition
requestingthe agency to adopt, amend, or repeal any rule is filed, the agency
shall file awritten ruling denying the petitionand stating the agency’s reasonor
reasons for the denial orthe agency shall initiate proceedings in accordancewith
chapter 91, HawaiiRevised Statutes, forthe adoption, amendment,or repeal of
the rule. In either event, the agency shall send written notification ofthe agency’s
actionto the petitionerby certified mail, return receipt requested. [Elf.FEB 09
