HAR §16-23-1. Definitions

Unless the context indicates otherwise, as used in this chapter: "Chapter 431", and reference to sections therein, refer to the insurance code contained in the Hawaii Revised Statutes (HRS). "Commissioner" means the state commissioner of insurance as defined in section 431:2-102, HRS. Pending the appointment of a person to or during any vacancy in that office, it refers to the state director of commerce and consumer affairs. "County" means the counties of Hawaii, Maui, and Kauai and the City and County of Honolulu. "Motor vehicle insurance law" refers to the motor vehicle insurance law, chapter 431:10C, HRS, and sections therein. "Prepaid health care plan" means a health care plan approved by the department of labor and industrial relations and meeting the requirements of chapter 393 and the rules of the department in effect on January 1, 1998, or thereafter. "Provider" or "health care provider" means any person providing medical or rehabilitative services to a claimant covered by a motor vehicle insurance policy.
