§16-23-70 Allocation of the Joint Underwriting
Plan costs. All costs incurred in the operation of
the joint underwriting plan bureau and the operation
of the plan, such as administrative, staff, and claims
(other than assigned claims) paid, shall be allocated
fairly and equitably among the joint underwriting plan
members.
The allocations shall be computed on a "share of
the voluntary market" basis.
Allocation of private passenger non-fleet
experience will be on the basis of net direct written
car years.
Allocation of commercial and all other experience
will be on the basis of net direct written premiums.
Member insurers or the statistical agencies
designated by them shall report all of the data
necessary to comply with the allocation procedures to
the commissioner or agent designated by the
commissioner. Each insurer shall permit its
statistical agent to release such data to the
commissioner or agent designated by the commissioner.
