Any individual, organization, or agency operating a day care center for disabled persons, who wilfully makes any false statement or who violates these rules shall be cited by the department and fined an amount deemed to be appropriate by a court of appropriate jurisdiction, but not to exceed the maximum of $5,000. If any part, section, subsection, paragraph, subparagraph, or clause àf this chapter, or its application to any person or circumstance, is for any reason held to be unconstitutional or invalid, the remaining portions of this chapter, or the application of this chapter to other persons or circumstances shall not be affected.
