When a child enters care if there is a child support order already in effect for that child, the child support funds will be IDAHO ADMINISTRATIVE CODE IDAPA 16.06.01 Department of Health and Welfare Child and Family Services Section 437 Page 19 redirected to the department to contribute to the cost of the child’s care. If there is no child support order already in effect, a new child support case will not automatically be opened. The department may initiate a child support case for a child in care, in its discretion, if the department concludes that doing so is in the best interest of the child. This provision does not limit the authority of the department to initiate or otherwise litigate child support on other grounds. (7-1-25)
