Waivers

The Director may amend the priority list and grant a waiver from the provisions of these rules on a case-by-case basis upon full demonstration that the following conditions exist. (7-1-26) 01. Public Health Protection. The requirement is not necessary for the protection of public health and the environment and does not affect the priority ranking status of the project. (7-1-26) 02. Affordability Criteria Exceeded. The project will exceed affordability criteria adopted by the Department in the event the waiver is not granted. (3-24-22) 996. – 999. (RESERVED)
