Section 105.108Â Dismissal of
Petition
A petition is subject to
dismissal if the Board determines that:
a)Â Â Â Â Â Â Â Â The petition does not contain the informational requirements
set forth in Section 105.210, 105.304, 105.408, 105.506, or 105.608;
b)Â Â Â Â Â Â Â Â The petition is untimely under Section 105.206, 105.302,
105.404, 105.504, or 105.606;
c)Â Â Â Â Â Â Â Â The petitioner fails to timely comply with any order issued by
the Board or the hearing officer, including an order requiring additional
information;
d)Â Â Â Â Â Â Â Â The petitioner does not have standing under applicable law to
petition the Board for review of the State agency's final decision; or
e)Â Â Â Â Â Â Â Â Other grounds exist that bar the petitioner from proceeding.
