Execution of an EMSA

Section 187 Section 187.408  Execution of an EMSA a)         An EMSA developed in accordance with this Part, and which has been approved by the Director, shall become effective upon signature by the sponsor and the Director. b)         An EMSA shall operate in lieu of all applicable environmental requirements under Illinois statutes, regulations, and existing permits that are identified in the EMSA.  Any environmental statute, regulation or condition in an existing permit that differs from a term or condition in an EMSA shall cease to apply from the effective date of an initial or renewed EMSA until it is terminated or expires. c)         An EMSA executed in accordance with this Part shall be made publicly available and shall be distributed to all members of the stakeholder group.
