Section 309 Section 309.181  Appeal of Final Agency Action on a Permit Application a)         If any NPDES Permit has been issued or denied by the Agency, any appeal of the issuance or denial of the permit, or of any of its terms or conditions, must be to the Board according to its Procedural Rules. b)         The appeal must be filed within 35 days after final Agency action.
