Section 309 Section 309.244  Appeals from Conditions in Permits An applicant may consider any condition imposed by the Agency in a permit issued under Subpart B as a refusal by the Agency to grant the permit, which entitles the applicant to appeal the Agency's decision to the Board under Section 40 of the Act.
