Standard for Permit Issuance or Certification

Section 405 Section 405.102  Standard for Permit Issuance or Certification a)         The Agency will issue or certify a permit if the operator submits adequate proof that the mine related facilities and mining activities will be constructed, prepared and operated without causing a violation of the Act or Subtitle D. b)         The Agency may issue an experimental permit under 35 Ill. Adm. Code 405.107 despite subsection (a).
