Statement of Basis

Section 705 Section 705.142  Statement of Basis The Agency must prepare a statement of basis for every draft permit or notice of intent to deny for which a fact sheet under Section 705.143 is not prepared.  The statement of basis must briefly describe the derivation of the conditions of the draft permit and the reasons for them or, in the case of notices of intent to deny, reasons supporting the tentative decision.  The statement of basis must be sent to the applicant and to any other person who requests it.
