Section 728.131Â Waste-Specific
Prohibitions:Â Dioxin-Containing Wastes
a)Â Â Â Â Â Â Â Â The dioxin-containing wastes specified in 35 Ill. Adm. Code
721.131 as USEPA Hazardous Waste Numbers F020, F021, F022, F023, F026, F027,
and F028 are prohibited from land disposal, unless the following condition
applies:Â the dioxin-containing waste is contaminated soil and debris resulting
from a CERCLA response or a RCRA corrective action.
b)Â Â Â Â Â Â Â Â USEPA Hazardous Waste Numbers F020, F021, F022, F023, F026, F027,
and F028, and dioxin-containing waste that is contaminated soil and debris
resulting from a CERCLA response or a RCRA corrective action listed in
subsection (a) are prohibited from land disposal.
c)Â Â Â Â Â Â Â Â This subsection (c) corresponds with 40 CFR 268.31(c), which
expired by its own terms on November 8, 1990. This statement maintains
structural consistency with the corresponding federal regulations.
d)Â Â Â Â Â Â Â Â The requirements of subsections (a) and (b) do not apply if
any of the following conditions is fulfilled:
1)Â Â Â Â Â Â Â Â The wastes meet the standards of Subpart D; or
2)Â Â Â Â Â Â Â Â A person has been granted an exemption from a prohibition
pursuant to a petition under Section 728.106, with respect to those wastes and
units covered by the petition; or
3)Â Â Â Â Â Â Â Â A person has been granted an extension from the effective date
of a prohibition pursuant to Section 728.105, with respect to those wastes and
units covered by the extension.
