Section 185.510 Provisions for Granting of Variance from Rules The Secretary may grant variances in individual cases from this Part in individual cases where it is determined that in their sole discretion that: a)         The provision from which the variance is granted is not statutorily mandated; b)         No party will be injured by granting the variance; and c)         The rule from which the variance is granted would, in the particular case, be unnecessarily burdensome.
