Section 2835 Section 2835.40  Benefits Received Without Fault The receipt of any sum paid to a claimant as benefits, due to agency error, is without fault.  A good faith mistake of fact by the claimant in the filing of his claim for benefits which results in an overpayment of benefits does not constitute fault.
