Section 390.1080 Social
Services
a)Â Â Â Â Â Â Â Â The facility shall provide Social services, needed by the
resident. These services shall be provided to the residents by or with
consultation of a qualified social worker through the use of social work
methods directed toward: (B)
1)Â Â Â Â Â Â Â Â Maximizing the social functioning of each resident.
2)Â Â Â Â Â Â Â Â Enhancing the coping capacity of the resident or his family.
3)Â Â Â Â Â Â Â Â Asserting and safeguarding the human and civil rights of the
residents and their families, and fostering the human dignity and personal
worth of each resident.
b)Â Â Â Â Â Â Â Â The resident and his family shall be helped by social workers
during the evaluation process, which may or may not lead to admission, to
consider alternative services, based on the resident's status and salient
family and community factors, and to make a responsible choice as to whether
and when residential placement is indicated.
c)Â Â Â Â Â Â Â Â Each resident shall be evaluated within 30 days of admission
regarding the need for such services and the results of such evaluation shall
be entered in the medical record.
d)Â Â Â Â Â Â Â Â Social workers shall participate, when appropriate, in the
continuing interdisciplinary evaluation of individual residents for the
purposes of initiation, monitoring, and follow-up of individualized
habilitation programs.
e)Â Â Â Â Â Â Â Â As appropriate during the developmentally disabled person's
admission to and while receiving services in the facility, the social worker
shall provide liaison between him, the facility, the family, and the community,
so as to help the staff to:
1)Â Â Â Â Â Â Â Â Individualize and understand the needs of the resident and his
family in relation to each other.
2)Â Â Â Â Â Â Â Â Understand social factors, including staff-resident
relationships, in the resident's day-to-day behavior.
3)Â Â Â Â Â Â Â Â Prepare the resident for changes in his living situation.
f)Â Â Â Â Â Â Â Â Social workers shall help the family to develop constructive
and personally meaningful ways to support the resident's experience in the
facility through:
1)Â Â Â Â Â Â Â Â Collateral counseling concerned with problems associated with
changes in family structure and functioning.
2)Â Â Â Â Â Â Â Â Referral to specific services, as appropriate.
3)Â Â Â Â Â Â Â Â Help the family to participate in planning for the resident's
return to home or other community placement.
g)Â Â Â Â Â Â Â Â The facility shall employ sufficient, appropriately qualified
staff, and necessary supporting personnel to carry out the various social
service activities to meet the program needs of the residents. (B)
h)Â Â Â Â Â Â Â Â If the facility designates a social worker who does not meet
the definition of "qualified social worker" in Section 390.330, then
that person shall receive adequate consultation from a person who meets the
definition of "qualified social worker" in Section 390.330.
