Variances and Suspensions of Rules
Section 1300.150Â Variances and Suspensions of Rules
The provisions of this Part may be waived or suspended by
the Board when it finds that:
a)Â Â Â Â Â Â Â Â the provision from which
the variance is granted is not statutorily mandated;
b)Â Â Â Â Â Â Â Â no party will be injured
by the granting of the variance; and
c)Â Â Â Â Â Â Â Â application
of the rule from which the variance is granted would, in the particular case,
be unreasonable or unnecessarily burdensome.
