Appeals of Disciplinary Action or Demotion

Section 1 Section 1.130  Appeals of Disciplinary Action or Demotion a)         A certified employee who has been served with written charges approved by the Director of Central Management Services for removal, discharge, demotion or suspension for a period of more than 30 days within a 12-month period may appeal to the Commission.  The appeal shall be in writing and filed with the Commission within 15 days after receipt of the approved written charges. b)         In disciplinary appeals and demotion appeals, the agency has the burden of proof and as such is designated the Petitioner; the employee is designated the Respondent.
