Section 731.405  Treatment and Effect of Wholesale Service Emergency Situations The standards contained in any plan will not be considered to be violated for the period of any delay due to a wholesale service emergency situation. Notwithstanding anything to the contrary in this Part, in those situations where a standard cannot be satisfied at all as a result of a wholesale service emergency situation, the failure to satisfy such standard shall not be deemed to be a violation of the applicable standard set forth in the plan.
