Recommended Decision

Section 104 Section 104.290  Recommended Decision a)         After the close of a hearing, the hearing officer shall prepare a written recommended decision which shall be based upon the evidence adduced at the hearing or otherwise included in the record.  The recommended decision shall contain findings of fact and recommendations. b)         This recommended decision shall be submitted to the Director.  The hearing officer shall also send a copy of the recommended decision to the Respondent or his counsel and to the Department's counsel.  Both Respondent and the Department's counsel may file written exceptions with the Director within 10 days of receipt. Both Respondent and the Department's counsel may file a written response to the exceptions with the Director within 5 days of receipt of the exceptions.
