Section 336.180 Interpreters
and Translation of Documents
a) A party whose language of preference is not English, or who will
require communication assistance, shall declare his or her language of
preference to the ALJ or the Department's legal representative at the
pre-hearing conference or at the earliest opportunity. The Department shall
provide an interpreter at no cost to the party.
b) At
the time of the pre-hearing conference, if the ALJ determines that translation
of documents is necessary to the conducting of a full and fair hearing, an
order shall be entered directing the Department to translate the relevant
documents. All due diligence shall be applied to the Department's translation
of relevant documents. A request for translation of documents shall not be
considered a delay on the part of the Department or the appellant.
