Section 385.100
Confidentiality of Background Check Information
Any employee of the
Department of Children and Family Services,
Illinois
State
Police, or a child care facility receiving confidential information under
Section
4.1 and Section 4.3 of the Child Care Act of 1969
who gives or causes to be
given any confidential information concerning any criminal convictions
or
child abuse or neglect information
of a child care facility applicant, or
child care facility employee,
or volunteer of a child care facility or
non-licensed service provider,
prospective certified relative caregivers,
or an adult resident of a prospective certified relative caregiver home,
shall
be guilty of a Class A misdemeanor unless release of such information is
authorized by
Section 11.1 of the Abused and Neglected Child Reporting Act
[325 ILCS 5] and Sections 3.4, 4.1 and 4.3 of the Child Care Act of 1969 [225
ILCS 10/4.1 and 4.3].
