Section 1 Section 1.230  Petitions: Amending, Supplementing or Withdrawing A petitioner may supplement or amend a petition without agency approval and without prejudice at any time until the Director rules on the petition or the petition has been referred for a hearing. The petitioner shall make the request for withdrawal in writing to the Director. All requests for withdrawal of a petition will be granted, but the withdrawal will be subject to predjudice if the request is made after a ruling by the Director or referral for hearing.  Withdrawal subject to prejudice means that the petitioner cannot resubmit a petition on the same issue or factual basis.
