Bulletin 61 MINE SUBSIDENCE COVERAGE FOR PUBLIC AND COMMERCIAL STRUCTURES May 2, 1990 Pursuant to an official opinion from the Office of Surface Mining (OSM), this bulletin is to inform insurers offering Class III(a) coverage that grant funds may not be used to pay for claims for damage to public or commercial structures. The intent of the original statute is to provide coverage for homeowners with property located over the Illinois coal basin. Due to the fact that the fund is not currently self-sufficient, effective June 1, 1990 no new business should be written on public or commercial structures. Mine Subsidence coverage now in place will be honored through the current policy year. An insured non-renewing Mine Subsidence coverage must comply with I.C. 27-1-31-3(1)(2); Notice of Policy Non-Renewal Forty-Five (45) Days Written Notice To The Policyholder. John J.
