460 IAC 6-29-4 Compliance of environment with building and fire codes

Sec. 4. (a) A provider designated in an individual's ISP as responsible for providing environmental and living arrangement support shall ensure that an individual's living areas comply with the requirements of this section. (b) An individual's living areas shall meet Indiana Code and local building requirements for single family dwellings or multiple family dwellings as applicable. (c) An individual's living areas shall contain a working smoke detector or smoke detectors that are: (1) tested at least once a month; and (2) located in areas considered appropriate by the local fire marshal. (d) An individual's living areas shall contain a working fire extinguisher or extinguishers that are inspected annually. (e) An individual's living area shall, if required by the individual's ISP: (1) contain operable antiscald devices; or (2) have hot water temperature no higher than one hundred ten (110) degrees Fahrenheit.
