470 IAC 6-4.4-1 Claim establishment and collection

Sec. 1. Claims shall be established and collected upon in accordance with 7 CFR 273.18 with the following exceptions: (1) The state agency shall take action to establish a claim against any household that received an overissuance due to inadvertent household or administrative error for which three (3) years or less have elapsed between the month an overissuance occurred and the month the state agency discovered a specific case involving an overissuance. (2) The state agency shall take action to establish a claim for an alleged intentional program violation (IPV) error for which six (6) years or less have elapsed between the month an overissuance occurred and the month the state agency discovered the overissuance. (3) Collection on claims shall be terminated when all adult members of a household are deceased.
