760 IAC 2-20-33 Qualification of long term care insurance policies, certificates, and riders

Sec. 33. (a) No long term care insurance policy, or certificate, or rider shall qualify for participation in the Indiana long term care program unless the long term care insurance policy, or certificate, or rider complies with this rule. (b) The commissioner of the department of insurance may not approve a long term care facility policy or certificate as a qualified policy or certificate for participation in the Indiana long term care program unless the issuer has an approved qualified integrated policy or certificate. (c) The commissioner of the department of insurance may not approve a long term care facility policy or certificate eligible for favorable tax status as a qualified policy or certificate for participation in the Indiana long term care program unless the issuer has an approved qualified integrated policy or certificate eligible for favorable tax status. (d) Long term care insurance policies, and certificates, and riders in force at the effective date of this rule may, with the signed acceptance of the policyholder or certificateholder, be amended to meet the requirements for qualification.
