Sec. 40. "Unreasonable hazard to the safety of life or property" means a condition that is likely to: (1) be caused by the design or construction of a project; and (2) result during a regulatory flood in either: (A) the loss of human life; or (B) damage to public or private property to which the license applicant has neither ownership nor a flood easement.
