312 IAC 11-1-2 Authority to grant, condition, or deny a license

Sec. 2. (a) The authority to grant, condition, or deny a license under IC 14-26 rests with the director or a delegate. (b) An action taken under subsection (a) is subject to administrative review by the commission under IC 4-21.5 and 312 IAC 3-1. (c) Before issuing a license under this rule, the department shall consider the following: (1) The public trust doctrine. (2) The likely impact upon the applicant and other affected persons, including the accretion or erosion of sand or sediments.
