312 IAC 26-4-5 Professional standards for historic preservation projects involving acquisitions

[NOTE: IC 14-12-3 is repealed by P.L. 123-2026, SECTION 21, effective July 1, 2026.] Sec. 5. The following standards apply if a project under this rule involves land acquisition: (1) Careful consideration shall be given to the type and extent of property rights that are required to assure the preservation of the historic resource. The preservation objective shall determine the exact property rights to be acquired. (2) A property shall be acquired in fee simple when absolute ownership is required to ensure its preservation. (3) Every reasonable effort shall be made to acquire sufficient property with the historic resource to protect its historical, archaeological, architectural, or cultural significance.
