313 IAC 3-1-8 Compliance with precatory restrictions

Sec. 8. An artifact that is subject to a precatory restriction shall not be considered by the board under section 7(c) of this rule until the corporation makes a good faith effort to: (1) comply with the restriction; and (2) notify the individual, if living, from whom the artifact was accessioned. If the individual is not living and the artifact was accessioned within the last twenty (20) years, the corporation shall make a good faith effort to notify the heirs or assigns of the decedent. If the heirs or assigns cannot be identified or located, the corporation shall give notice by publication in the newspaper having the greatest circulation in the county where the individual last resided, and in Marion County if the place of last known residence is outside Indiana.
