326 IAC 1-2-36 "Lowest achievable emission rate" defined

Sec. 36. For any facility, that rate of emissions which reflects the more stringent of the following: (1) the most stringent emissions limitation and/or the limitation resulting from equipment standards which are contained in the state implementation plan for such class or category of facility unless the owner or operator of the proposed facility demonstrates to the commissioner that such limitations are not achievable or; (2) the most stringent emissions limitation resulting from equipment standards or which has been achieved in practice by such class or category of facility.
