327 IAC 5-1.5-37 "New source" defined

Sec. 37. "New source" means any building, structure, facility, or installation from which there is or may be a discharge of pollutants, the
construction of which commences:
(1) after promulgation of standards of performance under Section 306 of the Clean Water Act which are applicable to such source;
or
(2) after publication of proposed standards of performance in accordance with Section 306 of the Clean Water Act that are applicable
to such source if the standards subsequently are promulgated in accordance with Section 306 of the Clean Water Act.
