327 IAC 6.1-2-45 "Pollutant" defined

Sec. 45. "Pollutant" means an organic substance, an inorganic substance, a combination of organic and inorganic substances, or a pathogenic organism that, after discharge and upon exposure, ingestion, inhalation, or assimilation into an organism either directly from the environment or indirectly by ingestion through the food chain, could, on the basis of information available to the commissioner, cause: (1) death; (2) disease; (3) behavioral abnormalities; (4) cancer; (5) genetic mutations; (6) physiological malfunctions, including malfunction in: (A) reproduction; or (B) physical deformations in either organisms or offspring of the organisms.
