The following Bulletin is to advise the reader of the current position of the Kentucky Department
of Insurance (the “Department”) on the specified issue. The Bulletin is for informational
purposes only and is not legally binding on either the Department or the reader.
Please review the information in this Bulletin carefully as it contains information regarding
temporary filing procedures for public adjuster contracts as required by HB 232 pending the
promulgation of regulations.

On March 17, 2023 Governor Beshear signed HB 232 into law which makes several changes to
statutes affecting public adjusters. One specific change will amend KRS 304.9-433 to require public
adjusters to file any template contracts that they intend to utilize when contracting with an insured
with the Department of Insurance (the “Department”) for approval, prior to those contracts being
used. This law will go into effect on June 29, 2023.
The Department is in the process of drafting and promulgating an administrative regulation detailing
the process by which contracts are to be filed. Until such time as that administrative regulation is
effective, the Department is implementing interim procedures for the filing of public adjuster
contracts, so public adjusters can comply with the new statutory requirement referenced above.
Beginning on June 29, 2023, Public adjuster contracts must be filed in accordance with the new
statutory provisions set out in HB 232. In order to create a central repository for those contracts so
that they can be efficiently reviewed, they should be sent via email to doi.licensingmail@ky.gov for
Department approval. Attachments should be in PDF format and must comply with the requirements
set forth in the KRS 304.9-433, as amended by HB 232.
