LAC 42:III.3905. Sealing of Documents

A. The board or hearing officer may allow any party to an administrative action to file a document or portions of a document with the board or hearing office under seal if: 1. the document or portions of the document contain information that is confidential pursuant to the Act or these rules; 2. the party makes a request in writing or on the record of an administrative hearing to allow the filing of the document or portions of the document under seal, setting forth the reasons that such filing under seal should be permitted; 3. the party requesting the filing of the document or portions of the document under seal has, to the extent practicable, segregated the portions of the document containing confidential information from the remainder of the document so that no more of the document than is necessary is filed under seal; and 4. the board or hearing officer finds that the public interest in maintaining the confidentiality of the information outweighs the public interest in making the information public.
