A. When notice has been sent to a respondent’s address of record via U.S. Certified or Registered Mail and the respondent fails to appear without good cause, the adjudicative hearing may proceed in the absence of the respondent. When the respondent fails to appear, the hearing panel shall first conduct an evidentiary hearing to determine whether the respondent was sent notice of the hearing as required by this Part. B. When an adjudicative hearing proceeds according to this section, the rules concerning evidence and proof remain applicable.
