LAC 48:XXV.515. Action by Department

A. The attorney general shall review the completed application. Within 90 days after receipt of a completed application or within one 90 day extension, the attorney general shall either: 1. approve the application, with or without specific modifications and issue a certificate; or 2. disapprove the application for a certificate. B. Any approval shall be conditioned upon the periodic submission of specific data relating to cost, access, and quality, and to the extent feasible, identify objective standards of cost, access, and quality by which the success of the arrangement will be measured. 1. The department’s decision shall be in writing and be based upon findings of fact and conclusions of law supporting the decision. 2. The department may condition approval on a modification of all or part of the proposed arrangement. 3. A copy of the department’s decision shall be sent, by certified mail, to the applicant. All persons on record shall be provided notice of the decision. 4. If the department does not issue a decision within 90 days after the receipt of a completed application or within one 90 day extension, the application shall be considered denied.
