LAC 33:I.1405. Applicability

A. These rules and regulations apply to facilities which are required under solid waste regulations or hazardous waste regulations to produce annual reports concerning the groundwater condition at their sites, to facilities which have installed groundwater monitoring systems, and to facilities conducting assessment and/or remediation of groundwater contamination (regardless of whether said contamination originated from a regulated waste management unit or from a non-regulated facility) for which the department is providing oversight. These rules and regulations do not apply: 1. to sites over which other departments, such as the Department of Natural Resources, are legitimately exercising oversight and to which the department provides no assistance or technical guidance; 2. to sites regulated under the underground storage tank regulations; or 3. to facilities billed under the authority of another Part or Chapter of Title 33 for the same activity.
