RE: Issuance of Temporary Producer Licenses
The purpose of this bulletin is to provide new and updated information regarding the issuance of temporary producer licenses.
Pursuant to M.G.L. c. 175, §162Q, the Commissioner may issue a temporary insurance producer license for a period not to exceed 180 days in the following circumstances:
(1) to the surviving spouse or court appointed representative of a disabled or deceased insurance producer;
(2) to a licensed producer who is a member or employee of the business entity and was designated on the business entity application;
(3) to the designee of a licensed producer entering the military; or
(4) in any other circumstance in which the Commissioner believes that the public interest will be best served.
The Commissioner may limit the authority of any temporary licensee and may revoke a temporary license if the interest of the insureds or the public is endangered.
Any temporary licensee's insurance activities must be conducted under the supervision of a licensed insurance producer who is in good standing. The supervising producer must be licensed to sell the lines of insurance marketed by the agency that he/she will be supervising and the supervising producer must be on the business premises during business hours.

A temporary producer license may not be continued after the business is sold.
The request for a temporary license must be submitted in writing and must include a copy of the death certificate of the deceased producer, the name, address, telephone number and social security number of the individual requesting the temporary license, as well as the name and producer license number (or social security number) of the supervising producer. The request must be notarized and signed by both the individual requesting the temporary license and the supervising producer.
This Bulletin supersedes the provision entitled “Deceased Spouse Provision” in Bulletin 2002-08.
