310 CMR 3.11
Processing Requests for Disclosure of Public Records
In compliance with M.G.L. c. 66, § 10, the Department shall, at reasonable times and without
unreasonable delay, permit any person, under the supervision of Department personnel, to inspect and
examine any public record which is in the custody of the Department and not described in 310 CMR
3.10(1) through (5); and the Department shall furnish one copy of such record on request and on
payment of a reasonable fee. Every person for whom a search of public records is made shall pay the
actualexpense of such search. Unless more time is reasonably required to properly determine whether
the records in question are subject to disclosure as public records or exempt from disclosure, the
Department shall comply with a written request to inspect or copy a public record within ten days after
the Department actually receives the request. Whenever a cost or fee is established or determined by
the Commissioner of Administration, said cost or fee shall be paid to the Department.
