Department Right of Entry

For the purpose of administration and enforcement of M.G.L. c. 21E and 310 CMR 40.0000 and for the protection of human health, safety, public welfare or the environment, employees, agents and contractors of the Department may enter any site, vessel or any other location to be investigated as a possible site at reasonable times and upon reasonable notice to investigate, sample or inspect any documents, conditions, equipment, practice or property. In the event that the Department reasonablydetermines as a result of an investigation, sampling or inspection that there has been a release or that there exists a threat of release of oil or hazardous material, the Department may enter a site, vessel or location, and areas proximate thereto, and perform or arrange for the performance of such response actions as it reasonably deems necessary.
