Applicability

Any person who is liable or potentially liable under M.G.L. c. 21E, § 5(a)(1) or (2) for certain releases of oil and/or hazardous material on Downgradient Property, and who satisfies the requirements and procedures set forth in 310 CMR 40.0183 or 40.0187, may submit to the Department a Downgradient PropertyStatus Submittal in accordance with 310 CMR 40.0183(3), or a Modification of a Downgradient Property Status Submittal in accordance with 310 CMR 40.0187(2).
