Right to Appeal
Any person who has been denied certification or whose certification has been revoked may
make a written request for an adjudicatory hearing before the Department pursuant to
M.G.L. c. 30A and 310 CMR 1.01: Adjudicatory Proceeding Rules for the Department of
Environmental Protection. The request for a hearing must be sent by certified mail or
hand-delivered, and received by the Department within 21 calendar days of the date of receipt
of the decision being appealed. The request for hearing shall state specifically, clearly, and
concisely the facts which are the grounds for the appeal, the relief sought, and any additional
information required by 310 CMR 1.01(6)(b) or other applicable law or regulation. In every
proceeding the burden shall be on the applicant for, or the holder of, a certification to
demonstrate compliance with 310 CMR 42.00.
