Time: How Computed
(1) Unless otherwise specifically provided by 456 CMR or other applicable law, computation
of time under 456 CMR 12.00, shall begin with the first day following the act, event or default
that initiates the running of the time period. The last day of the time period shall be included
unless it is a Saturday, Sunday or legal holiday, in which event the period shall run until the end
of the next business day.
(2) Whenever a party has the right or is required to do some act within a prescribed period of
time, if the Department serves notice of such right or requirement by mail, the Department shall
presume that the party received notice thereof three days from the date of issuance of such notice.
If the Department serves notice of such right or requirement electronically, the Department shall
presume that the party received notice thereof on the date of electronic transmittal. The
presumption may be rebutted by evidence of later receipt.
(3) For good cause shown, the Department may, within its discretion, extend any deadline for
filing under 456 CMR.
