501 CMR: EXECUTIVE OFFICE OF PUBLIC SAFETY 501 CMR 3.00: PRIVACY AND CONFIDENTIALITY Section 3.01: General Provisions 3.02: Digitized Imaging 3:01: General Provisions Please refer to 801 CMR 3.00 for the General Provisions of 501 CMR 3.00. 3.02: Digitized Imaging (1) Definition. “Digitized Image”, a computer generated likeness of a data subject produced by scanning either the data subject or the data subject’s photograph. (2) Imaging. A holder shall disseminate the digitized image or photograph of any data subject, including the data subject’s signature, upon request, either in writing or by electronic transmission, by any criminal justice agency as defined in M.G.L. c. 6, § 167 conducting official business. 501 CMR 3.02 (2) shall in no way limit any rights of any law enforcement or criminal justice agency to obtain any other data as provided by statute, regulation, or judicial order. 501 CMR: EXECUTIVE OFFICE OF PUBLIC SAFETY (PAGES 19 THROUGH 26 ARE RESERVED FOR FUTURE USE.)
