General Provisions

The purpose and objective of 105 CMR 100.000 is to encourage competition and the development of innovative health delivery methods and population health strategies within the health care delivery system to ensure that resources will be made reasonably and equitably available to every person within the Commonwealth at the lowest reasonable aggregate cost advancing the Commonwealth's goals for cost containment, improved public health outcomes, and delivery system transformation. Any action taken by a Provider Organization, Health Care Facility, or other Entity in an effort to circumvent the purpose and objective of 105 CMR 100.000 is a violation of 105 CMR 100.000.
