Failure to Inform the Massachusetts Historical Commission
Should a state body or a private project proponent fail to notify the MHC about a project, to
provide the MHC with the information necessary to determine whether the project will adversely
affect a State Register property, to identify and assess alternatives to the project, to meet with the
MHC to discuss alternatives, or to respond in detail to the MHC's Statement of Prudent or
Feasible Alternatives, or proposed Joint Memorandum of Prudent and Feasible Alternatives, then
the state body shall not proceed with the project or in the case of a private project, shall not fund
or license such project, until the MHC states that such failure has not frustrated the purpose of
M.G.L. c. 9, §§ 26 through 27C.
