Waiver of Requirements Imposed on Hospitals
The Commissioner may waive the applicability to a particular hospital of one of more of the
requirements imposed by 105 CMR 130.000 upon finding that:
(A) Compliance would cause undue hardship to the hospital;
(B) The hospital’s non-compliance does not jeopardize the health or safety of its patients and
does not limit the hospital’s capacity to give adequate care;
(C) The hospital has instituted compensating features that are acceptable to the Commissioner;
and
(D) The hospital provides to the Commissioner written documentation supporting its request
for a waiver.
